1. Acceptance of Terms

By accessing or using shaka.ai (“the Service”), operated by its owners (“we,” “us,” “our”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

shaka.ai generates a daily AI-created song synthesized from publicly available world news sources. The Service includes audio content, visual knowledge graph representations, karaoke-style lyrics, and related features. Content is generated using artificial intelligence tools including but not limited to Anthropic Claude, ElevenLabs, and OpenAI Whisper.

3. Intellectual Property & Content Ownership

All rights reserved. All content generated by the Service — including but not limited to songs, lyrics, audio recordings, visual representations, knowledge graphs, creative palette selections, council outputs, and musical direction prompts — is the exclusive intellectual property of the Service's owners. © 2026 shaka.ai.

Songs created by shaka.ai are original works produced under human creative direction using AI tools. We assert copyright over the selection, arrangement, coordination, and curation of all generated output as compilation works under U.S. copyright law.

You are granted a limited, non-exclusive, non-transferable, revocable personal streaming license to access and listen to the daily song for personal, non-commercial use only. This license is granted free of charge for today's song and through a paid subscription for archived content.

This license does not grant you any right to:

• Download, copy, reproduce, or distribute the audio content
• Create derivative works, remixes, or samples from the content
• Use the content for commercial purposes, including in videos, podcasts, or broadcasts
• Publicly perform or publicly display the content
• Remove or alter any copyright or attribution notices
• Reverse engineer the generation pipeline or creative systems
• Train AI models on the content
• Claim authorship or ownership of any generated content

We reserve the right to revoke this license at any time, for any reason, without notice.

3a. DMCA Notice & Takedown

All audio recordings, lyrics, and creative content on shaka.ai are protected under the Digital Millennium Copyright Act (DMCA) and applicable international copyright treaties.

If you believe that content on this Service infringes your copyright, please provide the following to our designated DMCA agent:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the infringing material and its location on the Service
• Your contact information (name, address, email, phone)
• A statement of good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid DMCA notices promptly. Repeat infringers may be permanently banned from the Service.

4. AI-Generated Content Disclaimer

All songs, lyrics, and creative content are generated by artificial intelligence. While we strive for accuracy, inclusivity, and cultural sensitivity:

• AI-generated content may contain errors, inaccuracies, or unintended representations
• News synthesis may not perfectly represent the original reporting
• Musical representations of cultural traditions are AI interpretations, not authentic performances
• Lyrics may not exactly match what is heard in the audio (ground truth is the audio)
• We do not guarantee the accuracy, completeness, or appropriateness of any content

5. News Sources & Third-Party Content

The Service aggregates publicly available RSS feeds from third-party news sources. We do not own, control, or endorse the news content from these sources. News story titles and summaries are displayed for the purpose of showing connections to the generated song. All news content remains the property of its respective publishers.

6. Paid Subscriptions & Archive Access

Today's song is available free of charge. Access to the archive of past songs requires a paid subscription (“Supporter” status). Payments are processed by Stripe. By purchasing a subscription:

• You agree to Stripe's terms of service
• Monthly subscriptions renew automatically until cancelled
• You may cancel at any time; access continues until the end of the billing period
• One-time payments grant access for 365 days from the date of purchase
• Refunds are available within 7 days of purchase if you have not accessed archived content
• We reserve the right to change pricing with 30 days notice to existing subscribers

7. Sharing & Social Media

You may share links to shaka.ai and its daily songs on social media. You may share the auto-generated Open Graph preview cards. You may NOT share, upload, or repost the actual audio files, full lyrics, or substantial portions of the generated content on any platform.

8. Binaural Audio & Health Disclaimer

Some songs may contain binaural beats or other audio techniques designed to promote relaxation or focus. These are not medical treatments. If you have epilepsy, a seizure disorder, or are sensitive to specific audio frequencies, consult a healthcare provider before using the Service. We make no medical claims about the effects of our audio content.

9. Cultural Sensitivity

We strive to represent all cultures, traditions, and philosophical perspectives with respect and authenticity. Our creative palette includes instruments, vocal styles, and philosophical lenses from many traditions worldwide. If you believe any content is culturally insensitive, appropriative, or harmful, please contact us. We take these concerns seriously and will review and update content as needed.

10. Privacy

We collect minimal data: playback interactions for Service functionality, Stripe payment information for subscriptions (processed by Stripe, not stored by us), and standard web analytics. We do not sell personal data. We do not use your data to train AI models.

11. Limitation of Liability

The Service is provided “as is” without warranty of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to: emotional distress from content, inaccurate news representations, cultural misrepresentation, audio-related health effects, or service interruptions.

12. Modifications

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via the Service.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which the Service owners reside.
